Strong From Within – Online Programme Terms & Conditions

These Terms & Conditions apply to participation in the Strong From Within online programme provided by Discover Pilates, operated by Emma Smale as a sole trader (“Discover Pilates”, “I”, “me” or “my”).

Please read these Terms before purchasing. By purchasing Strong From Within, you agree to these Terms & Conditions.

1. The Programme

Strong From Within is a six-week online exercise and educational programme.

The programme includes:

 

• prerecorded weekly sessions;

• three live Zoom sessions;

• downloadable information and trackers;

• weekly support and individual email check-ins;

• the opportunity to ask relevant private questions by email; and

• access to the programme content for 12 months.

 

The programme is intended to provide exercise, movement and educational support.

It is not medical treatment, physiotherapy or a substitute for individual assessment, diagnosis or treatment from an appropriately qualified healthcare professional.

 

2. Price and Payment

The price of Strong From Within will be clearly displayed before you purchase.

Payment is made in full at the time of purchase and is processed through the payment provider shown at checkout.

There are no recurring subscription payments unless expressly stated otherwise before purchase.

Your place is confirmed once payment has been successfully completed.

 

3. Programme Start and Access

 

The programme start date will be clearly stated at the time of purchase.

Purchasing the programme does not provide immediate access to the paid programme content unless expressly stated otherwise.

Login and access information will be provided before the programme begins.

Your 12-month access period begins when access to the programme content is provided.

 

4. Statutory Cancellation Rights

 

If you purchase Strong From Within online, you may have a statutory right to cancel your contract within 14 days of entering into it without giving a reason.

To exercise your right to cancel, contact emma@discoverpilates.co.uk with a clear statement that you wish to cancel.

If you cancel within an applicable statutory cancellation period and no programme services or digital content have been supplied at your request, you will receive a full refund.

If you ask for services or digital content to begin during an applicable statutory cancellation period, different rules may apply. Where required, I will provide the relevant information and obtain any necessary express request, consent or acknowledgement before the service or digital content begins.

Nothing in these Terms affects your statutory consumer rights.

 

5. Cancellation Outside Statutory Cancellation Rights

 

Places on Strong From Within may be limited.

If you wish to cancel outside any applicable statutory cancellation period, please contact me as soon as possible.

Any request for a refund outside an applicable statutory cancellation period will be considered on a case-by-case basis, taking account of all relevant circumstances, including programme content or services already provided, costs reasonably incurred, the timing of the cancellation and whether your place can reasonably be filled.

I may also provide a refund, credit or alternative arrangement in exceptional circumstances.

Nothing in this section affects your statutory consumer rights.

 

6. PAR-Q and Health Information

 

You must complete the required PAR-Q or health questionnaire before participating in the programme.

You must provide accurate information and tell me about relevant medical conditions, injuries, pregnancy, surgery, symptoms or other circumstances that may affect your ability to participate safely.

You must also tell me if relevant circumstances change during the programme.

I may recommend that you obtain advice or clearance from an appropriate healthcare professional before participating or continuing where I reasonably consider this appropriate.

 

7. Health and Medical Advice

 

Strong From Within is not intended to diagnose, treat or cure a medical condition.

Information provided through the programme is general exercise and educational information and is not individual medical advice.

If you have symptoms or concerns that require medical assessment, you should seek advice from an appropriately qualified healthcare professional.

Participation in Strong From Within should not be used as a reason to delay seeking medical advice, diagnosis or treatment.

 

8. Results

 

Every participant’s circumstances are different.

Although Strong From Within is designed to support pelvic health, movement, strength and body awareness, specific results cannot be guaranteed.

Participation does not guarantee that symptoms will improve or resolve.

 

9. Your Responsibility When Exercising

 

Exercise involves some inherent risk.

You are responsible for exercising within a range appropriate for you and following any relevant medical advice you have received.

You should stop exercising and seek appropriate advice if you experience pain or symptoms that concern you.

When completing online exercise sessions, you are responsible for ensuring that you have sufficient safe space to exercise and that your environment and any equipment you use are suitable.

 

10. Email Support and Weekly Check-Ins

 

During the six-week programme, I will provide a weekly email check-in. Participants may reply with programme-related questions and I will provide reasonable support within the scope of the programme.

You may also contact me with relevant private questions by email during the programme.

Email support does not provide continuous or emergency access to me and is not an emergency, medical or diagnostic service.

 

11. Zoom Sessions and Recordings

 

Strong From Within includes three live sessions delivered using Zoom.

Live Zoom sessions may be recorded so that recordings can be made available as part of the programme.

If you choose to have your camera or microphone switched on during a recorded session, your image, voice and anything you choose to share may be included in the recording.

Where appropriate, separate consent will be requested in relation to recording and the use of identifiable participant information.

You do not have to agree to be identifiable in a recording in order to participate in the programme.

If you do not wish to appear or be heard in a recording, you may keep your camera and microphone switched off during recorded parts of the session and submit questions privately where reasonably practicable.

Recordings made available to participants are confidential programme material and must not be downloaded, copied, recorded, shared, distributed or made available to anyone outside the programme unless I expressly permit this.

 

12. Programme Access

 

Your purchase provides you with a personal, non-transferable right to access Strong From Within for 12 months from the date programme access begins.

Your login details and programme access are for you only.

You must not share your login details or allow another person to access the programme using your account.

 

13. Intellectual Property

 

All Strong From Within videos, recordings, written materials, PDFs, trackers, graphics and other programme content remain the intellectual property of Discover Pilates unless otherwise stated.

You may download and print downloadable materials provided as part of the programme for your own personal use.

You must not share, reproduce, distribute, sell, upload or commercially exploit programme content or use it to teach, reproduce or create another programme without my permission.

 

14. Technology and Access

 

You are responsible for having suitable internet access and a device capable of accessing the programme content and Zoom.

I cannot be responsible for problems caused by your own internet connection, device, software or equipment.

If a significant technical failure involving a platform or service used by Discover Pilates prevents access to programme content for a material period, I will take reasonable steps to restore access.

Where appropriate, I may extend your access period by a reasonable amount so that you do not lose a significant portion of the access you purchased.

Nothing in this section affects any statutory remedies you may have if digital content or services are not provided as required by law.

 

15. Behaviour

 

Participants must communicate respectfully with me and other programme participants.

I may restrict participation in live or group elements where a participant behaves in an abusive, threatening, discriminatory or seriously disruptive way or creates a genuine safety concern.

Any action taken will be proportionate to the circumstances and will not affect your statutory consumer rights.

 

16. Liability

 

I will provide Strong From Within with reasonable care and skill.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these Terms excludes or restricts your statutory rights in relation to services or digital content.

 

17. Privacy

 

Personal information, including relevant health information, will be processed in accordance with the Discover Pilates Privacy Notice available on my website.

 

18. Circumstances Outside My Reasonable Control

 

Occasionally circumstances outside my reasonable control may affect the delivery of part of the programme.

Where this happens, I will take reasonable steps to minimise disruption and, where appropriate, provide a reasonable alternative, reschedule an affected live element, extend access or provide any remedy required by law.

 

19. Changes to These Terms

 

I may update these Terms from time to time.

The Terms applying to your purchase will normally be those provided or made available to you when you purchased the programme, except where a change is required by law or is otherwise agreed with you.

 

20. Governing Law

 

These Terms are governed by the laws of England and Wales.

Nothing in these Terms limits any rights you have regarding the court in which a consumer dispute may be brought.
